Introduction

Welcome to Pivotal Personal Training (“we,” “us,” or “our”).
By accessing our website, booking services, or engaging in training (online or in-person), you agree to the following Terms and Conditions.

 

Please read them carefully before using our services. If you do not agree to these terms, please refrain from using our website or services.

Services Provided

Pivotal Personal Training offers personalized fitness coaching and related services, including but not limited to:

  • Online personal training programs
     

  • In-person training sessions
     

  • Nutrition guidance and habit coaching
     

  • Fitness assessments and progress tracking
     

All programs are designed for general fitness and well-being purposes and are not a substitute for medical advice.

Eligibility

To participate in our services, you must:

  • Be at least 18 years of age (or have written consent from a parent or guardian if under 18);
     

  • Complete a health screening or PAR-Q (Physical Activity Readiness Questionnaire);
     

  • Disclose any relevant medical conditions, injuries, or limitations truthfully.
     

We reserve the right to refuse or discontinue services if it is determined that participation may pose a health risk or if false information has been provided.

Health Disclaimer

Before beginning any exercise or nutrition program, consult with a qualified healthcare provider, especially if you have any pre-existing medical conditions or concerns.

By engaging in our programs, you acknowledge that:

  • Participation is voluntary;
     

  • You assume full responsibility for your health, safety, and well-being;
     

Pivotal Personal Training and its representatives are not liable for any injuries, illnesses, or damages arising from participation in training, whether online or in person.

Payment and Fees

All fees for training services are clearly outlined prior to purchase.
Payment terms are as follows:

  • Payments are due prior to the start of training unless otherwise agreed upon in writing.
     

  • Accepted payment methods include e-transfer, credit card, or other approved platforms.
     

  • Prices are listed in Canadian dollars (CAD) and are subject to applicable taxes.
     

Late or missed payments may result in suspension of services.

Cancellations and Refunds

A. In-Person and Online Training Sessions

  • Clients must provide at least 24 hours’ notice to cancel or reschedule a session.
     

  • Sessions cancelled with less than 24 hours’ notice may be forfeited and charged in full.
     

B. Program Packages and Online Coaching

  • Refunds are not provided for partially completed programs or unused sessions.
     

  • In exceptional cases (e.g., medical issues, relocation), refunds or credits may be considered at the discretion of Pivotal Personal Training.
     

C. Business Cancellations
In the rare event that a session or program must be cancelled by Pivotal Personal Training, clients will be notified promptly and offered a rescheduled session or refund.

Client Responsibilities

Clients agree to:

  • Follow all training and safety instructions provided.
     

  • Communicate any discomfort, injuries, or health changes immediately.
     

  • Refrain from sharing login details, program materials, or proprietary content with others.
     

Use the online platform or website responsibly and lawfully.

Intellectual Property

All materials provided by Pivotal Personal Training — including workout programs, documents, videos, and digital content — are the intellectual property of Pivotal Personal Training and are protected by copyright laws.

You may not reproduce, distribute, or modify any materials without prior written consent.

Limitation of Liability

To the fullest extent permitted by law, Pivotal Personal Training and its affiliates are not liable for any:

  • Direct, indirect, or consequential damages;
     

  • Injuries, losses, or claims arising from participation in training or use of our website;
     

  • Errors, omissions, or interruptions in service delivery beyond our control.
     

You agree to release and hold harmless Pivotal Personal Training and its representatives from any claims related to your participation.

Privacy

Your privacy is important to us.
Personal information is collected, used, and protected in accordance with our [Privacy Policy], which complies with PIPEDA and BC’s Personal Information Protection Act (PIPA).

 

By using our services, you consent to the handling of your personal information as described in that policy.

Online Services and Communication

Online coaching and communication may be conducted via third-party platforms (e.g., email, video conferencing, fitness apps).
While we take reasonable precautions to protect your data, we cannot guarantee complete security of electronic communication and you accept these risks.

Termination of Services

Pivotal Personal Training reserves the right to terminate services immediately if:

  • A client engages in abusive, unsafe, or unethical behavior;
     

  • Payment obligations are not met;
     

  • The client repeatedly violates these Terms and Conditions.
     

In such cases, unused sessions may be forfeited at the business’s discretion.

Changes to Terms and Conditions

We may update these Terms and Conditions periodically to reflect business or legal changes.
The updated version will be posted on our website with a revised effective date. Continued use of our services indicates your acceptance of the updated terms.

Governing Law

These Terms and Conditions are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein.
Any disputes shall be resolved within the jurisdiction of British Columbia.
